ECO Canada Job Board – Terms of Service

Effective Date: May 4, 2026

Welcome to ECOWorks Job Board ("Platform"), operated by ECO Canada ("ECO Canada", "we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.

These Terms form a legally binding agreement between you and ECO Canada.



1. Eligibility and Account Registration

To access certain features of the Platform, you must create an account. By registering, you confirm that you are at least 18 years of age.

You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your login credentials secure and confidential
  • Be responsible for all activity conducted under your account
  • Not impersonate any person, employer, organization, or entity

We reserve the right to suspend or terminate accounts that provide false information, impersonate others, or otherwise violate these Terms.



2. Use of the Platform

The Platform is intended for:

  • Posting and viewing job opportunities in the environmental sector
  • Applying for jobs
  • Recruiting and hiring activities
  • Career-related services and information

You agree to use the Platform only for lawful purposes and in accordance with these Terms. Unauthorized or improper use may result in immediate suspension or termination of your account.



3. Job Listings and Employer Responsibilities

Employers posting job listings agree that:

  • All job postings are accurate, truthful, lawful, and not misleading
  • They have the authority to post the position and represent the employer organization
  • They will comply with all applicable employment, human rights, and privacy laws including the Canadian Human Rights Act and applicable provincial legislation
  • Job postings will not discriminate based on any protected ground including race, gender, age, disability, religion, sexual orientation, national or ethnic origin, or any other ground protected by law
  • Each position will be posted only once — duplicate or spam listings are prohibited
  • Posted positions represent genuine, available employment opportunities

ECO Canada does not independently verify the identity of employers or confirm the existence of posted positions. While we review listings for quality, we cannot guarantee:

  • The accuracy or completeness of any job posting
  • The legitimacy of employers, organizations, or job offers
  • Employment outcomes for job seekers

Job seekers are responsible for conducting their own due diligence before applying to any position.



4. Job Applications and Job Seeker Responsibilities

Job seekers agree to:

  • Provide truthful and accurate information in all applications
  • Ensure submitted documents including resumes and cover letters are their own work or properly authorized
  • Understand that ECO Canada is not a party to, and has no involvement in, hiring decisions or employment outcomes

We are not responsible for employer actions, hiring decisions, interview processes, or any outcome arising from a job application made through the Platform.



5. Payments, Credits, and Refunds

Job posting credits and subscriptions

Certain features of the Platform require payment, including the purchase of job posting credits or subscription plans. By completing a purchase, you agree to pay all applicable fees at the rates displayed at the time of purchase.

Credit expiry

Job posting credits are valid for 12 months from the date of purchase unless otherwise stated at the time of purchase. Unused credits expire at the end of this period and are non-transferable.

Auto-renewal

Where subscription plans are offered, they will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be notified of upcoming renewals in advance.

Cancellation

You may cancel a subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

Refunds

Credits and subscription fees are non-refundable except in the following circumstances:

  • A technical error on our part prevented you from using a credit or feature you paid for
  • A job posting was removed by ECO Canada due to an error on our part rather than a violation of these Terms
  • Required by applicable consumer protection law

To request a refund, contact us at info@eco.ca within 30 days of the relevant transaction.

Failed payments

If a scheduled payment fails, we will notify you and attempt to process payment again. Active job postings may be suspended until payment is resolved. ECO Canada is not liable for any loss of visibility or applications resulting from a payment failure.

Payment processing

All payments are processed securely by our third-party payment provider. ECO Canada does not store credit card information.



6. User Content

The Platform allows you to submit content including resumes, cover letters, job postings, profile information, and communications.

You retain full ownership of all content you submit. By submitting content, you grant ECO Canada a non-exclusive, worldwide, royalty-free license to host, store, and display your content solely for the purpose of operating and improving the Platform.

ECO Canada will not:

  • Sell your content to third parties
  • Use resume or application content for AI model training purposes
  • Share your personal content with third parties except as outlined in our Privacy Policy

You are solely responsible for the accuracy, legality, and appropriateness of all content you submit.



7. Prohibited Activities

You agree not to:

  • Post false, misleading, fraudulent, or discriminatory information
  • Impersonate any person, employer, organization, or entity
  • Post duplicate or spam listings to manipulate search results or visibility
  • Use the Platform for any illegal purpose
  • Harass, abuse, threaten, or harm other users or ECO Canada staff
  • Attempt unauthorized access to any account, system, or data
  • Use bots, scrapers, crawlers, or automated tools without prior written permission from ECO Canada
  • Upload malicious code, viruses, or any software that could interfere with Platform operations
  • Violate any applicable laws or the rights of any third party

Violations may result in immediate suspension or permanent termination of your account without refund.



8. Privacy

Your use of the Platform is governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information. Our Privacy Policy is available at ecoworks.eco.ca/privacy and is incorporated into these Terms by reference.

By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.



9. Platform Availability and Changes

We may at any time and without prior notice:

  • Modify, update, or discontinue any feature or part of the Platform
  • Restrict access to certain features or user groups
  • Perform scheduled or emergency maintenance

We will make reasonable efforts to notify paying users of planned downtime in advance. ECO Canada is not liable for any loss arising from temporary unavailability, service interruptions, or platform changes.



10. Intellectual Property

All content, branding, design, software, and functionality of the Platform — excluding user-submitted content — are owned by ECO Canada or its licensors and are protected by applicable intellectual property laws in Canada and internationally.

You may not copy, reproduce, distribute, modify, or commercially exploit any part of the Platform without prior written permission from ECO Canada.



11. Third-Party Services

The Platform may integrate with or link to third-party services, websites, or tools. ECO Canada is not responsible for:

  • The content, accuracy, or availability of third-party websites
  • Services or products provided by third parties
  • Privacy practices of external platforms

Use of any third-party service is at your own risk. We encourage you to review the terms and privacy policies of any third-party service you access through or in connection with the Platform.



12. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

ECO Canada does not warrant that:

  • The Platform will be error-free, uninterrupted, or secure
  • Job listings are accurate, complete, or current
  • Employers are legitimate or that posted positions exist
  • The Platform will meet your specific requirements or expectations

To the maximum extent permitted by applicable law, ECO Canada disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.



13. Limitation of Liability

To the maximum extent permitted by law, ECO Canada is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.

This includes but is not limited to:

  • Loss of data or content
  • Loss of employment opportunities
  • Business interruption
  • Damages resulting from user interactions, job postings, or hiring decisions

In all cases, ECO Canada's total aggregate liability to you shall not exceed the greater of (a) the total amount paid by you to ECO Canada in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100).

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by applicable law.



14. Indemnification

You agree to indemnify, defend, and hold harmless ECO Canada, its affiliates, officers, directors, employees, and partners from and against any claims, damages, losses, liabilities, costs, or expenses — including reasonable legal fees — arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Content you submit to the Platform
  • Your violation of any applicable law or third-party rights

15. Dispute Resolution

Good faith resolution

Before initiating any formal legal proceeding, both parties agree to attempt to resolve any dispute in good faith through direct communication. Either party may initiate this process by providing written notice describing the nature of the dispute and the resolution sought. The parties will have 30 days from receipt of such notice to attempt resolution before proceeding further.

Governing law

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict of law principles.

Jurisdiction

If a dispute cannot be resolved through good faith negotiation, both parties agree to submit to the exclusive jurisdiction of the courts located in Calgary, Alberta, Canada.



16. Termination

ECO Canada reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, for:

  • Violations of these Terms
  • Conduct deemed harmful to the Platform, its users, or ECO Canada
  • Any other reason necessary to protect the integrity of the Platform

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and dispute resolution — will continue to apply.



17. Accessibility

ECO Canada is committed to making ECOWorks Job Board accessible to all users. We strive to meet applicable accessibility standards under the Accessible Canada Act and applicable provincial legislation. If you experience an accessibility barrier on the Platform, please contact us at info@eco.ca and we will work to address it promptly.



18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Platform, business practices, or applicable law. Updates will be posted on this page with a revised Effective Date.

Where changes are material, we will make reasonable efforts to notify registered users by email in advance of the changes taking effect.

Your continued use of the Platform after updated Terms are posted constitutes your acceptance of those Terms.



19. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.



20. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ECO Canada regarding your use of the Platform and supersede all prior agreements or understandings relating to the same subject matter.
